Contract with “AITA PERU”
The terms and conditions set forth below (the “Terms”) refer to “AITA PERÚ” (“AITA PERÚ”, “we” or “our”) and the customer (the “Client” or “You”) with “aita” Peru”. As used in the Terms, “AITA PERÚ”, “we” and “our” include the owners, directors, officers, employees, representatives, agents and affiliates of “AITA PERU”.

Reservations
To reserve a space on any trip, each Client must send:
Full personal information of all travelers Full name, such as in your passport
Passport number, nationality, age, sex.
Confirm if it is Student or Student, Students only publish during the 24 years of age, “Have a student card during the year and the expiration date printed on it”.
Confirm the trip and the date of departure.
Report on the commented meals “vegetarian, allergies, etc.” A deposit of 50% per person (payment by credit card, online payment, deposit by western union, Money Gram, 61 or more days before the trip).
The balance of the cost of the trip (the “Balance”) expires 05 days before departure at our office in Lima or Cusco.

payments
The balance payment can be made by:

Individual supplement.
All accommodations (hotels, boats, tents, etc.) are based on double occupancy. We will try to find roommates for individual travelers who wish to share accommodation. If this is not feasible or if you prefer an individual accommodation, you will be charged the single Supplement charge listed in the itinerary.

Cancellation by the client.
If it must be canceled, all cancellations must be in writing. If it is made 15-45 days before departure, the fare is 50% of the cost of the trip and if it is made 15 days before departure, the cancellation fee is 100% of the cost of the trip. No partial refunds will be granted for unused hotel rooms, meals, excursions or trekking arrangements for any reason. The cost of the trip is quoted as a package and credits for unused services are not granted. Some trips like the Inca Trail to Machu Picchu. In this case, the ship’s cancellation policy is added to the “AITA PERÚ” cancellation policy.

Cancellation by “AITAPERU”
“VIAJES AITA PERU” reserves the right to cancel any trip due to insufficient registrations (which do not meet the minimum of 2 people), which makes the trip economically unfeasible to operate. If this happens, a full refund of the cost of the trip is granted. However, “AITAPERU” is not responsible for the additional expenses incurred by travelers preparing for the trip (ie, non-refundable air tickets of “Advance Purchase”, equipment, medical expenses, etc.).

Prices, surcharges and validity
As we publish our prices in advance, “AITA PERU” may occasionally face significant cost increases due to factors over which we have no control. Accordingly, we reserve the right to charge the Customer a surcharge due to unfavorable exchange rates, increases in air fares or other transportation costs, taxes, or if the government action should require us to do so. Surcharges will be calculated based on the total additional cost, compared to the original costs and exchange rates. In the same way, if our costs decrease, we will transfer the savings to the Client.

Airlines
“AITAPERU” is not responsible for any act or breach of any airline. We may use airlines other than the one (s) mentioned in our advertisements, and “AITA PERU” can not guarantee the type of aircraft that will be used by any airline. In addition, “AITA PERU” is not responsible for losses due to canceled flights, or changes in flight itineraries or seat assignments. The Client can not cancel the contract without penalty due to a change of airline, type of aircraft, route or destination. The responsibility of the airlines is limited to the transport of passengers and baggage in accordance with the terms and conditions of service of the airline.

Delays
Any cost, direct or incidental, incurred by the Client as a result of delays caused by bad weather, road conditions, river levels, transportation delays, illness, government intervention or other contingencies beyond the control of AITA PERU. It will be refunded.

Changes for “AITA PERU”
Reasonable changes to the itinerary may be made when “AITA PERU” deems it convenient for the comfort and welfare of the Clients due to unforeseen circumstances or circumstances beyond the control of “AITA PERU.” If this change is made before it is 50% of the deposit is paid, the Client will be informed of the change at the time of booking If the change is made thereafter, “AITA PERU” will inform the Customer as soon as reasonably possible. as a result of such change they will be subject to the provisions of Paragraph 5 above. “AITA PERU” will not be liable for any damages arising or related to such change and the Client waives the right to claim such damages against “AITA PERU”.

Changes by the client
Any change made by the Client between 60 and 30 days before departure will be charged an administrative fee of $ 30 per change. Any change made between 29 and 15 days will have an administrative charge of $ 50 per change. The customer can not make changes within 14 days after departure. This includes, without limitation, reserving additional accommodations, transfers or excursions. “AITA PERU” is not responsible for the additional expenses incurred by the Client as a result of said changes, which include, among others, the “Non-refundable” “AITA PERU” “Advance Purchase”.

Authority on the Tour
The client must comply at all times with the laws and respect the social norms of the country that is visited, as well as with all the governmental regulations related to customs, drugs and currencies. At all times, the decision of the leader or representative of the “AITA PERU” tour is final in all matters that may threaten security or interfere with the welfare of the group or individual Clients. In the event that the Client does not comply with this section, or if the Client interferes with the welfare of the group or individual Clients, the leader or representative of the “AITA PERU” tour may order the Client to abandon the visit without resorting to no refund

Medical condition and health
It is vital that Clients with medical problems communicate them to us at the time of registration. The trip leader has the right to disqualify any person at any time during the trip if the trip leader believes that the continued participation of the Client will endanger the health or well-being of the Client involved or the group. Refunds are not given under such circumstances. In case a client is injured or becomes ill, “AITA PERU” will try to obtain the best medical attention available. However, “AITA PERU” assumes no responsibility for the provision of medical care or its cost.

Luggage
“AITA PERU” assumes no responsibility for loss or damage of luggage in transit to and from a “AITA PERU” trip or during a “AITA PERU” trip.

Travel insurance
“AITA PERU” strongly recommends that the client obtain personal travel insurance, including baggage insurance and cancellation.
- – Travel insurance is a cost-effective way to protect yourself and your equipment in case of problems due to: canceled trips, delays, medical problems, loss of luggage or damage.
- – Travel insurance can be purchased through traditional insurers or online insurers.

Travel documents
The Client must obtain and have a valid passport (the PASSPORT MUST BE VALID AT LEAST 185 DAYS FROM THE DATE OF DEPARTURE), all visas, permits and certificates, and the necessary vaccination certificates for the entire journey. The customer accepts the responsibility of obtaining these documents and any other necessary documents. The information or advice provided by “AITA PERU” on visas, vaccines, weather, clothing, luggage, special equipment, etc., is provided in good faith but without liability on the part of “AITA PERU” and the Client expressly waives any I claim that “AITA PERU” is responsible for the damages arising from said information or advice.

Claims and complaints
If a Client has a claim or claim against “AITA PERU”, the Client must first inform “AITA PERU” of the claim or claim in writing within five days after the end of the trip. Failure to comply with this requirement waives the right of the Client to assert such claim or claim against “AITA PERU”.

Binding arbitration

Limitation of remedies
The Client accepts that the only remedy for any breach of “AITA PERU” that arises from the Terms will be the return of the cost of travel paid. To the maximum extent permitted by applicable law, “AITA PERU” shall not be liable for any indirect, special, incidental or consequential damages of any kind (including personal injury) regardless of the form of the action, whether in contract, tort (including negligence), or otherwise, even if “AITA PERU” has been warned of the possibility of such damages, and the Client expressly waives any right he may have to recover such damages.

Separability
I understand and agree that in the event that one or more of the provisions of the Terms, for any reason, are considered invalid or not applicable in any respect, such invalidity or inapplicability will not affect any other provision of this document, and the Terms they will be interpreted as if such an invalid or unenforceable provision has never been contained here.

Complete agreement.
The Terms contain all the understanding between the Client and “AITA PERU” in relation to the subject of the Terms and supersedes all prior negotiations, statements and representations related to the subject of the Terms, unless expressly contained in the Terms.

Amendment.
The Terms can not be modified, except by means of a written amendment executed by the Client and “AITA PERU”.

Construction.
It is the intention of the Client and “AITA PERU” that no part of the Terms is construed against any part due to the identity of the editor.

Medical insurance
All clients must be covered by personal medical insurance related to the trip. The insurance must cover personal accidents, medical expenses, air ambulance, loss of effects, repatriation costs and all other expenses that may arise as a result of a loss, damage or injury that occurs to the Client. The Client agrees to obtain and / or verify that he / she has sufficient personal health insurance coverage related to the trip for the trip. Baggage and cancellation insurance are also highly recommended.
I agree to obtain and / or verify that I have personal medical insurance related to previous travel that meets the minimum requirements of “AITA PERU” and submit proof of said insurance to “AITA PERU”.

RELEASE OF RESPONSIBILITY AND ASSUMPTION OF ALL RISKS
I, the Client, acknowledge that I voluntarily requested to participate in the trip designated on this application and that I read the description of the trip as it appears on the trip itinerary. I am participating voluntarily in this trip with knowledge of the dangers involved.

ASSUMPTION OF RISK
“AITA PERU” does not own or operate any entity that provides goods or services for its trip, which include, among others, other lodging facilities, airlines, boats, buses or other transportation companies, suppliers or organizers of optional excursions, or food service or entertainment providers other than “AITA PERU”. “AITA PERU” notifies that it acts independently of, and is not responsible for, that owners, contractors and suppliers provide means of transportation and / or all other related travel services and assumes no responsibility for expenses, injuries, losses or damages to person or property resulting from: acts of God, detention, annoyance, delays, quarantine, strikes, theft, theft, force majeure (an event or effect that can not reasonably be anticipated)

LAUNCH
I acknowledge that the cost of all “AITA PERU” trips has been based on the Travel Clients that execute this Release of Liability and Assumption of All Risks. Therefore, as a legal consideration to participate in such adventure travel activities, I AM FREELY RELEASING AND DOWNLOADING “TRAVEL COUNTIES” AND AGAINST ANY RESPONSIBILITY ARISING FROM MY PARTICIPATION IN THE TRIP. I accept that this publication will legally obligate all minors under 18 years of age to travel with me, all members of my family, me and their heirs, successors, assigns and legal representatives, and I intend to assume all the risks of Travel associated with this trip and release “AITA PERU” from and of all liabilities to the fullest extent permitted by law.
FATHER OR GUARDIAN OF A MINOR
I, as the parent or guardian of the minor named below, give my permission for my child or ward to participate in the trip and also accept, personally and on behalf of my child or ward, the Terms.
Aita Peru Corporate data protection policy
AITA PERU in compliance with the provisions of Law 29733 Law on the Protection of Personal Data and its amendments, is committed to and guarantees the fundamental right to the protection of personal data, provided for in Article 2 paragraph 6 of the Political Constitution of Peru, data obtained from its customers, suppliers, staff, collaborators and any other natural person who has contact with AITA PERU, to ensure the exercise of their rights. The purpose of this document is to establish the necessary guidelines for the treatment of personal data contained in AITA PERU’s databases, in accordance with the provisions of Law 29733 and its amendments, whether digital or physical. The Corporate Policy for the Protection of Personal Data of AITA PERU covers all processes that manage personal data of clients, service providers, personnel, collaborators who work or have a direct relationship with the Company.
The Policy shall be known to and fully complied with by all AITA PERU personnel.
This Policy is integrated with the Information Security Manual and documentation related to the Management of reservations and services for national and foreign clients, data necessary to carry out tourist operations in our area, within the framework of the Risk Management of our company AITA PERU.
AITA PERU protects personal data, based on the following directives:
- Comply with the legal and contractual provisions in force regarding the protection of personal data, with the corresponding security measures.
- Guarantee the rights of privacy, intimacy, honour and good name in the processing of personal data collected by the Company, and consequently all its actions will be governed by the principles of legality, consent, purpose, proportionality, quality, and security, availability of resources and adequate level of protection.
- To safeguard and prevent access to personal data by any external third party; guaranteeing the exercise of the rights of access, rectification, cancellation and opposition of personal data.
Likewise, we inform our customers and users that they will be solely responsible for the data they provide in the forms with false, inaccurate, incomplete or out-of-date data.
- Establish and disseminate the responsibilities of the Company’s personnel and collaborators with regard to the processing of personal data.
- Raise awareness and train AITA PERU staff and collaborators through appropriate communication mechanisms, in order to strengthen the objectives, values and commitments in compliance with this policy.
- Ensure the provision of the resources required to establish, implement, maintain and continuously improve the implementation of the regulations.
Management will issue regulations and other relevant tools containing the details required for the proper implementation of this Policy.
